Client Terms of Service
These terms govern your use of BuildSmarts as a client hiring independent contractors. Signature is legally binding and is recorded with your IP address, device, and timestamp.
By clicking "I Agree" below, you ("Client") accept every clause of these Client Terms of Service.
1. Platform, Not Service Provider. BuildSmarts is a communication platform connecting clients with independent contractors. BuildSmarts does not perform construction, delivery, transportation, or travel services.
2. Independent Contractors. All workers, drivers, couriers, and contractors are independent contractors. They are not employees of BuildSmarts.
3. No Guarantee. BuildSmarts does not guarantee the quality, safety, reliability, or legality of any service provided by independent contractors.
4. Client Responsibility. Clients are responsible for verifying the qualifications, licenses, insurance, and references of any independent contractor they hire.
5. Release of Liability. Clients release BuildSmarts from any claims, damages, or losses arising from their interaction with independent contractors.
6. Indemnification. Clients indemnify BuildSmarts for any claims, damages, or losses arising from disputes with independent contractors.
7. Payment Terms. All payments must be made through the BuildSmarts wallet. Funds are held in escrow until the service is complete and approved.
8. Dispute Resolution. Any dispute arising from this agreement shall be brought exclusively in the courts of Toronto, Ontario, Canada.
9. Electronic Signature Consent. Clicking "I Agree" constitutes a legally binding electronic signature.
